Liability for Fires Caused By Electric Mowers
Consumer products routinely cause fires in the United States. According to Consumer Reports, “we found at least 15,700 fires clearly linked to problems with a product, much greater than the instances involved in recalls. The number could be closer to 35,000 if you consider cases in which there were either no contributing causes or they were undetermined.” There are a number of potential defects with an electric lawnmower that could potentially cause a fire.
- Electric lawn mowers are typically powered by lithium-ion batteries. These can overheat when damaged, misused, or made from faulty materials.
- Poor electrical connections inside of the lawnmower could potentially cause a short circuit and ignite nearby materials.
- Lawn mowers routinely operate in humid and wet conditions. Any moisture intrusion into the mower can lead to electrical faults and create a fire hazard.
Companies that create electric lawnmowers have to take into consideration all of the factors that could cause a fire and mitigate them. All companies have a legal obligation to create products that are reasonably safe. They must be safe in all of the likely environments their product could be used. They must also take into consideration all of the potential ways that their product might be misused. If there is a latent defect with an electric lawnmower that leads to a fire, this could form the basis of a strict product liability claim. It is important that certain steps are taken after any fire caused by an electric lawnmower.
- It should be determined if the lawnmower involved was part of any recall list.
- A police report of the incident should be created.
- The specific lawnmower involved in the accident should be preserved.
- An experienced product liability attorney should be contacted.
It can be hard to know where to begin after any fire involving a consumer product. Victims are often seriously injured and may need to take extensive periods of time away from work. Any person injured by a faulty product may be able to seek damages through a civil claim. This can help cover medical bills, lost wages, and pain and suffering. A product liability attorney can examine all of the unique facts of your case and let you know what your legal options are.
