Liability for Cook County Car Accidents
Every driver on the road in Illinois must operate with the caution necessary to avoid collisions. Many car accidents within the state are due to drivers that are speeding. According to Illinois Vehicle Code 625 ILCS 5/11-601, “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway, or endangers the safety of any person or property.” Drivers may have taken several other actions that contributed to an accident.
- Lane Changes: A driver may have failed to check their blind spots before making a lane change.
- Driver Distraction: Another major cause of collisions is driver distractions. Drivers may have been occupied with their cellphones and neglected to pay attention to the road ahead of them.
- Inadequate Maintenance: Vehicles must be routinely inspected and regularly maintained for them to operate safely.
If a driver fails to slow down to avoid colliding with another vehicle, this could form the basis of a negligence claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering. Unfortunately, insurance companies will often do everything in their power to deny responsibility for any collision. This is why it is so important that victims seek the guidance of an experienced attorney.
Liability for Rollover Car Accidents
Rollover collisions can be particularly dangerous. According to the IIHS, “In 2023, rollover crashes accounted for 21% of occupant deaths in cars, 38% of occupant deaths in pickups, and 34% of occupant deaths in SUVs.” There could be several liable parties for any rollover collisions.
- Tire Manufacturer: The company that manufactured the tires on a vehicle could be liable for an accident if the tire malfunctioned and caused a driver to lose control.
- Vehicle Manufacture: The company that manufactured a vehicle could be liable for injuries if the roof on the vehicle caved in during the rollover. The roofs on vehicles are supposed to remain stable in crashes to protect vehicle occupants.
- Employers: If the driver who caused an accident was working at the time of a collision, their employer could potentially be held vicariously liable.
Most car accidents are preventable. They often involve situations where drivers are not following traffic regulations. These accidents can be enormously disruptive to a person’s life. In many situations, victims are so badly injured that they must forgo many activities they love. It is important for victims of car accidents to understand that they do have legal options.
