Liability for Dangerous Consumer Products
Companies that create consumer products have a legal obligation to ensure that they are reasonably safe. Consider, for example, Greenman v. Yuba Power Products, Inc., “A manufacturer is strictly liable in tort when an article he places on the market, knowing that it is to be used without inspection for defects, proves to have a defect that causes injury to a human being.” There are a number of ways that a product could be defective.
- Design Defects: A product may have designed defects. These are inherent to the way that a product is created and exist before it is manufactured.
- Manufacturing Defects: A product may have manufacturing defects. These types of defects occurred during the creation of a product. Typically, they only affect a limited number of units out of all those produced.
- Marketing Defects: A product may have marketing defects. For example, the product may lack clear consumer instructions and adequate warnings. Consumers must be warned about the latent and non-obvious dangers associated with products.
The vast majority of accidents involving consumer products are preventable. They tend to involve situations where companies make safety shortcuts. This can include using lower quality materials. It can also include situations where safety regulations are ignored. Depending on the facts of any case, there could be more than one liable party if a consumer is injured by a product.
Steps to Take After Being Injured by Consumer Products
Many consumers are seriously injured or killed by consumer products every year. According to the Consumer Product Safety Commission, “In 2020, an estimated 28,535,000 people sought medical attention for an injury related to, but not necessarily caused by, a consumer product. This is a decrease of more than 7.7 million (21 percent) from the 2019 estimate.” People injured by consumer products should take certain measures to protect their rights.
- Medical Evaluation: Any person injured by a consumer product should seek a medical evaluation as soon as possible. They should also receive any ongoing treatment that they need. Failing to treat injuries can cause legal and medical problems down the road.
- Evidence Preservation: The consumer product that caused the injury should be stored in a secure location where it is not likely to cause further harm. It is an important piece of evidence that should be examined at a later time.
- Legal Support: Victims should seek the guidance of an experienced personal injury attorney. An attorney can examine the unique facts of your case free of cost and let you know what your legal options are.
Many people find it difficult to know where to begin after being injured by a consumer product. They may need to take extensive periods of time away from work. Any person injured by a consumer product is protected by a number of rights. They are able to seek compensation through a civil action. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
