KANE COUNTY, ILLINOIS (November 24, 2024) – A Mack semi-truck driver was critically injured in a Kane County semi-truck crash near the intersection of Miller Road and Route 31.
Kane County officials say that the incident took place before 7:40 a.m. on Tuesday. The driver of a freightliner semi-truck was eastbound on Miller Road when he allegedly didn’t stop at the stop sign.
That Freightliner collided with a Mack semi-truck and caused the first truck to exit the roadway and roll over. The Mack truck ended up rolling into a field.
Firefighters and paramedics were called to the scene in order to help the victim. The driver of the Mack truck was taken to Advocate Sherman Hospital in critical condition.
The driver of the freightliner sadly died due to his injuries.
Liability For Kane County Semi-Truck Accidents
Thousands of people are killed or seriously injured every year in semi-truck accidents. According to the National Safety Council, “The number of injuries in large-truck crashes increased 3.9% in 2022, to 161,000. As with deaths in large-truck crashes, most of the injuries occurred to occupants of other vehicles (73%), followed by truck occupants (26%) and non-occupants (1%).” There are a number of factors that can contribute to semi-truck accidents.
- Semi-trucks can weigh up to 80,000 lbs and are extremely difficult to stop.
- Semi-trucks have much larger blind spots than other vehicles.
- Semi-trucks have high centers of gravity, which makes it more likely that they will rollover.
Semi-truck drivers must get a commercial driver’s license. They are expected to be intimately familiar with how their vehicle operates and use the utmost care to avoid collisions. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1204, all drivers must come to a complete stop at stop signs and yield the right of way to approaching vehicles before entering the intersection. If a driver goes past a stop sign without yielding, this could form the basis of a negligence claim. Victims of semi-truck accidents tend to suffer very serious injuries.
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Depending on the facts of any case, liability for a semi-truck accident could extend beyond any driver. The company that a truck driver was working for at the time of a collision could also be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. However, many truck companies will hire their drivers as “independent contractors” to avoid liability for collisions.
