Liability for Cook County Accidents Involving Semi-Trucks
Semi-trucks account for a relatively small number of the total vehicles on the roadway. They can be particularly dangerous for those in passenger vehicles. According to the IIHS, “Most deaths in large truck crashes are passenger vehicle occupants. The main problem is the vulnerability of people traveling in smaller vehicles. Trucks often weigh 20-30 times as much as passenger cars and are taller with greater ground clearance, which can result in smaller vehicles underriding trucks in crashes.” Semi-truck drivers should take a number of measures in order to avoid collisions.
- Semi-truck drivers should check their blind spots before making turns in the roadway.
- Semi-truck drivers should be well rested before heading out onto the road.
- Semi-truck drivers should abstain from alcohol and other intoxicating substances.
Truck drivers are considered common carriers. They are expected to operate their vehicles with the utmost care. The driver of any vehicle approaching an intersection and about to make a left turn must yield the right-of-way to cross traffic and wait to proceed until it is safe to do so. Truck drivers must also yield the right-of-way to an emergency vehicle with its lights and sirens on. If a truck driver fails to exercise the right-of-way to cars or emergency vehicles, this could form the basis of a negligence claim.
Depending on the facts of any case, liability for a truck accident could extend beyond any driver. The company that owned or operated any truck could potentially be liable. Generally speaking, employers are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. Victims of semi-truck accidents tend to suffer very serious and costly injuries.
- Broken bones
- Head injuries
- Lacerations
- Organ damage
The vast majority of semi-truck accidents are preventable. They tend to happen when drivers are making one or more traffic errors. Part of the problem is that truck companies will often push their drivers to complete deliveries on unrealistic timelines. Indeed, one in ten truck drivers involved in a fatal collision reported feeling under pressure from their carrier. Any person injured in a truck accident may have legal recourse through a personal injury claim.
