Liability For Manhattan Car Accidents

Speeding remains one of the leading causes of car accidents in the United States. According to the NHTSA, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2021, speeding was a contributing factor in 29% of all traffic fatalities.” There are a number of factors that could contribute to a collision.

  • Inclement weather
  • Poor road conditions
  • Driver fatigue

According to Illinois Vehicle Code Sec. 11-601, no person shall operate a motor vehicle at a speed greater than what would be reasonable or safe given the prevailing conditions of the roadway. If a driver fails to slow down to avoid hitting another vehicle, this could form the basis of a negligence claim.

If the driver of a vehicle was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. there are many steps that should be taken after a car accident.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

Vehicle crashes tend to be very complex events. It is important that all evidence is preserved. Evidence is what will ultimately be needed to demonstrate liability for any crash. Any person that is injured in a car accident may have legal recourse through a civil claim. A civil claim can help cover many of the expenses that come with a serious injury.
