Liability For Cook County Apartment Fires
Residential fires remain one of the leading causes of preventable injury and death. According to the National Fire Protection Association, “Over the five-year period of 2015–2019 as a whole, cooking was the leading cause of home fires and home fire injuries, while smoking was the leading cause of home fire deaths.” Apartment owners should take a number of measures in order to prevent their residents from apartment fires.
- Apartment owners should install and maintain smoke detectors.
- Apartment owners should keep fire exits clear of obstructions.
- Apartment owners should use fireproof materials where required by law.

Apartment owners have a legal obligation under Illinois Civil Code (740 ILCS 130/1) to ensure that their buildings are reasonably safe and compliant with the fire code. They must install fire extinguishers where necessary. They must also work to correct dangerous conditions that they become aware of. It is important that certain steps are taken after any apartment fires.
- Victims should seek medical care as early as possible.
- The source of the fire should be determined.
- A thorough investigation should be conducted.
- An experienced personal injury attorney should be contacted.
Residential fires can be extremely difficult for all involved. Victims may be left with horrific injuries and lose all of their earthly possessions in the process. To make matters worse, apartment owners will often do everything in their power to deny responsibility if someone is injured in a fire in their building.
