Liability for Peoria Car Accidents

Every driver in Illinois has a legal obligation to exercise due care to avoid colliding with other drivers in the roadway. Pursuant to 625 ILCS 5/11-601(a), “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway, or endangers the safety of any person or property.” If a driver fails to slow down to avoid colliding with any vehicle, this could form the basis of a negligence claim. There are many other factors that could contribute to any collision.

  • Driver Distraction: Drivers may be distracted by their phones or many other objects.
  • Inclement Weather: Drivers are much more likely to be involved in collisions during periods of inclement weather, including rain.
  • Dangerous Turns: The vast majority of collisions at intersections are due to drivers that make dangerous turns. It can be hard for drivers to pay attention to oncoming traffic and cross traffic at the same time.

Depending on the facts of any case, there could be multiple liable parties for any car accident. This is particularly true if a vehicle was being used for commercial purposes when it was involved in a crash. For example, a truck may have been used to deliver materials for a construction project. A driver may have been transporting people in an Uber.

Preserving Evidence After a Car Accident

Gathering evidence is critical after any car accident. Evidence is what will ultimately be used to demonstrate what happened and what parties could be held liable. What follows are just a few of the pieces of evidence that should be reviewed after any collision.

  • Police Report: Police reports are not always accurate. But they do provide important insights into what may have led up to a crash.
  • Surveillance Footage: Many traffic intersections are covered by cameras. Businesses may also capture accidents on nearby streets.
  • Medical Records: The injuries and medical records after a collision are essential to help demonstrate the extent of a person’s injuries.

It can be difficult to know where to begin after any car accidents. Victims are often left with serious injuries and high medical bills. They may also need to take extensive periods of time away from work, thereby further straining their financial situation. It is important for victims to understand that they do have legal options. They are able to seek some measure of accountability through a bodily injury claim.
