It can also cause an electric shock and fire hazard for users. The affected units were sold exclusively on Amazon.
No injuries involving the Vornado Air VH2 Whole Room Heaters have been reported at this time.
Liability for Injuries Caused by Space Heaters
Injuries and fires involving electric space heaters remain all too common. According to one estimate by the Consumer Product Safety Commission, “portable heaters are involved in about 1,700 fires per year, resulting in about 80 deaths and 160 injuries annually.” Accidents are much more likely to occur during the winter months, which is when these products are more likely to be used. There are a number of common causes of fires involving electric space heaters.
- Fires could start if space heaters are placed too close to flammable materials, such as curtains, rugs, or bedding.
- Fires could start if space heaters are plugged into overloaded circuits that are not rated for high-wattage devices.
- Fires could start if a space heater lacked modern safety features, such as automatic shut-off mechanisms.
- Fires could start if space heaters have worn-out or frayed electrical cords.
Companies that create space heaters and other consumer electronic goods have a legal obligation to ensure that they are reasonably safe. They must take into consideration all of the ways that their product could potentially be used and misused over time. When a product has a design defect that contributed to a fire, this could form the basis of a product liability claim. Product liability may also occur if manufacturers failed to warn consumers about the non-obvious dangers associated with the use of their product. There are several elements that must be demonstrated in any prima facie case of product liability.
- The defendant sold the product that the plaintiff used.
- The defendant was the commercial seller of the product in question.
- The plaintiff suffered an injury while using the product.
- The product was defective when the defendant sold it.
- The defect with the product was the actual approximate cause of the plaintiff’s injury.
It can be hard to know where to begin after being injured by a defective product. Fires and electric shocks can leave victims with serious physical and emotional injuries. Many victims will need to take long periods of time away from work. They may also be left with high medical bills. It is important for accident victims to understand that they do have rights. They may be able to seek compensation for their injuries through a product liability claim. A product liability attorney can examine the unique facts of your case free of cost and let you know what your legal options are.
