Liability For Waukegan Car Accidents
Pedestrians are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the Governors Highway Safety Association (GHSA), “In 2020, the percentage of pedestrian fatalities involving speeding rose to 8.6%, a notable increase from 7.2% the year before. Speed has a significant impact on pedestrian safety.” There are a number of steps that drivers can take to prevent pedestrian accidents.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should use their turn signals to let pedestrians know about their intensions.
- Drivers should be well rested before heading out onto the road.
Every driver must use caution to avoid hitting pedestrians. According to Illinois Vehicle Code (625 ILCS 5/11-1003.1), drivers must exercise due care to avoid hitting any pedestrian in the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. A city could also potentially be liable for a pedestrian accident if it was caused by a dangerous condition on public property. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Many pedestrians may not realize the severity of their injuries for several weeks or months after a collision. It is important that accident victims are aware of their rights. Any person that is injured in a car accident may have legal recourse through a civil claim. It is extremely important that evidence is properly preserved after a pedestrian accident.
