Liability For Kane County Electrocution Accidents
Electrocutions remain a major cause of serious injury and death for workers. According to the National Fire Protection Association, “Electrocution was the fifth-leading cause of death in the workplace by the end of the 1970s; there were approximately 600 electrocutions annually at the time, accounting for about 8% of all workplace fatalities.” There are a number of steps that employers should take in order to prevent electrocutions.
- Employers should implement electrical safety programs.
- Employers should properly maintain all of their equipment.
- Employers should provide their workers with personal protective equipment, including rubber boots and insulated gloves.
- Employers should establish clear emergency protocols in the event of an electrical accident.
Any person that is injured in a work setting may have legal recourse through a worker’s compensation claim. Worker’s compensation in Illinois is based off of a no-fault insurance scheme. There is no need for an injured worker to show that one party or another contributed to their accident. It is available to all workers, regardless of fault. An injured worker may also be able to seek some measure of justice through a third-party liability claim.
There are numerous sources of third-party liability for any electrocution accident. Many electricians work as subcontractors for various businesses. If a property owner failed to maintain their premises in a reasonably safe condition, this could form the basis of a negligence claim. Many electrical hazards are preventable and the result of unsafe working conditions. It is important that certain steps are taken after any worker is injured on the job.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- The incident should be reported to OSHA.
Electrocutions are often highly preventable. They tend to happen when workers are operating in an unsafe environment. It is crucial that the source of the safety lapses is properly understood. It is also important that workers understand that they do have rights. They are able to seek some measure of accountability and aid through a civil claim. A personal injury attorney can examine all of the unique facts of your case and let you know what your legal options are.
