Liability for Chicago Workplace Accidents
Thousands of workers are seriously injured or killed in their jobs each year. According to the Bureau of Labor Statistics, “Of the 101,400 private industry injury and illness cases reported in Illinois, 64,500 were of a more severe nature, involving days away from work, job transfer, or restriction while recuperating—commonly referred to as DART cases. These cases occurred at a rate of 1.5 cases per 100 full-time workers, matching the national rate.” There are a number of hazards that workers face.
- Physical Hazards: Workers face a variety of physical hazards at their job sites. One of the most common physical hazards that they face is falls.
- Chemical Hazards: Workers are exposed to a variety of different chemical hazards in their job sites, including toxic fumes and combustible gases.
- Safety Hazards: Workers are routinely injured by electrical hazards and unguarded machinery.
Employers across Illinois have a legal obligation to protect their workers from hazards. When a worker is injured, they will typically have recourse through a workers’ compensation claim. This is a no-fault insurance claim that helps workers with lost wages and medical bills. An injured worker may also have recourse through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident.
There are numerous sources of third-party liability for any construction accident. In particular, municipalities typically manage public sidewalks. The sidewalks must be created so that they are in a reasonably safe condition. If a municipality has actual or constructive notice of a hazard with their sidewalk, and they fail to fix it, this could form the basis of a negligence claim if someone is injured. It is important that certain steps are taken after any workplace accident.
- Medical records related to the incident should be preserved.
- The condition of the worksite leading up to the accident should be scrutinized.
- A thorough investigation by OSHA should be conducted.
- An experienced Chicago personal injury attorney should be contacted.
Construction accidents are often highly preventable. One of the major drivers of accidents is safety violations. Construction projects can be expensive. Shortcuts designed to save time and money can needlessly expose workers to harm. Any person injured in a construction accident may have legal recourse through workers’ compensation and a personal injury claim. A personal injury attorney can examine the unique facts of your case for free and let you know what your legal options are.
