Five Below Issues Recall for Its Tabletop Fire Pits Because They Can Seriously Burn

CHICAGO, ILLINOIS (September 27, 2025) – Five Below Tabletop Fire Pits have been recalled because they pose a serious risk of burn injury and fire hazard.
The recall was issued on September 18, 2025. Roughly 66,000 units were sold prior to the recall.
According to the Consumer Product Safety Commission, alcohol fuel can spill out of the fire pit during use. This can cause flames to spontaneously jet out in an uncontrolled manner.
Five Below received one report of flames escaping the fire pit. No injuries have been reported to the company at this time.
Liability for Accidents Involving Faulty Consumer Products
Companies that make consumer products must keep safety in mind at all times. They have a legal obligation to test their products in all of the real-world scenarios they are likely to be used in. Companies that make devices that can light on fire must be particularly cautious. If a product is defective in some way and injures a consumer, this could create the basis of a product liability claim. There are three major ways that a product could be defective.
- Design Defects: A product may have a design defect. These types of defects are inherent to the way that a product is made and exist before it is manufactured.
- Manufacturing Defects: It was also possible that defects may occur when a product is being constructed or manufactured. In these instances, only a selected number of items will typically be defective.
- Marketing Defects: Products may have marketing defects if they lack adequate instructions. A marketing defect may also occur if a product lacks sufficient warnings about latent dangers.
Even if a product is defective due to some issue with its design, courts will typically use two tests to determine whether or not a defendant may be liable for resulting injuries. Under the risk utility test, a defendant will not be liable for defective design if there is sufficient evidence that the product utility outweighs any inherent risks of harm. With the consumer expectation test, a defendant will not be liable for a defective product if a reasonable consumer would not find the product to be defective when it is used in a reasonable way.
Steps to Take After Being Injured by a Consumer Product
Accidents involving consumer products are one of the leading sources of injury and hospitalization in the United States. According to the Consumer Product Safety Commission, “In 2020, an estimated 28,535,000 people sought medical attention for an injury related to, but not necessarily caused by, a consumer product. This is a decrease of more than 7.7 million (21 percent) from the 2019 estimate.” Certain actions should be taken after any injury involving a consumer product.
- Medical Evaluation: Victims should seek medical treatment as soon as possible. Many of the injuries associated with an accident may not be immediately obvious.
- Product Review: It should be determined if the product involved was on any recall list.
- Evidence Preservation: In the event of a legal claim, it is important to have the item in question that caused the injury. It should be stored in the secure location where it is not likely to hurt anyone else.
- Legal Support: Accident victims should take some time to explore their legal options with an experienced product liability attorney. An attorney can evaluate all the unique facts of your case and let you know if you have a claim that can be pursued.
Many consumers will blame themselves if they are injured by a consumer product. But the truth of the matter is that many of these accidents stem from defective products. Any person that is injured by a defective product may be able to seek some measure of accountability through a claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
