The cause of the mechanical malfunction has yet to be determined. A full investigation remains ongoing at this time.

Liability for McLean County Motorcycle Accidents

Every driver in Illinois has a legal obligation to exercise due care to avoid colliding with other drivers in the roadway. This requires that all drivers maintain a safe follow distance. According to Illinois Vehicle Code 625 ILCS 5/11-710, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway.” Several factors could contribute to motorcycle collisions.

  • Visibility: Motorcycles have a naturally small profile and are more likely to be overlooked by other drivers on the roadway.
  • Speed: Drivers are substantially more likely to collide with other vehicles if they are traveling at a speed that would be unsafe given the prevailing road conditions.
  • Time of Day: A large portion of motor vehicle collisions take place in the early morning and late evening hours, when there is less sunlight.
  • Inclement Weather: Poor weather conditions can dramatically increase the length of time that it takes for any vehicle to be brought to a safe stop.

If a driver fails to slow down to avoid colliding with any motorcyclist in the roadway, this could serve as evidence of negligence. It doesn’t matter whether or not the victim suddenly slowed down or stalled in the roadway. Drivers must constantly scan the road ahead of them and maintain a safe follow distance to avoid rear-end collisions. Depending on the specific facts of any case, liability for a motorcycle collision could extend to several parties beyond any negligent driver. This includes the company that manufactured a motorcycle or its component parts.

Motorcycle Manufacturer Liability for Motorcycle Collisions

A number of motor vehicle collisions are caused by some type of mechanical malfunction. According to the National Academies of Science, Engineering, and Medicine, “In about 2 percent (±0.7%) of the crashes, the critical reason was assigned to a vehicle component’s failure or degradation, and in 2 percent (±1.3%) of crashes, it was attributed to the environment (slick roads, weather, etc.).” If a mechanical malfunction contributes to a motorcycle collision, this could form the basis of a product liability claim. There are many types of defects with a motorcycle that could contribute to an accident.

  • Brake Failures: Leaking brake fluid could cause a motorcycle driver to lose control of their vehicle and go down in a roadway.
  • Tire Defects: If the tire on a motorcycle has any type of malfunction, this could cause a catastrophic separation of the outer treads and the steel belts.
  • Throttle Malfunctions: Another potential issue with motorcycles is a throttle malfunction. A throttle malfunction could cause the driver to accelerate unintentionally or prevent them from being able to slow down their vehicle as intended.
  • Driveshaft Failures: A broken chain or snapped belts could cause the engine of a motorcycle to suddenly lose power, which can lock up the rear wheels.

Many people have been seriously injured or killed in accidents involving motorcycle malfunctions. In particular, Harley-Davidson has recalled nearly 17,000 motorcycles when it was discovered that they could lose rear braking capability. It is important that the victims of motorcycle accidents understand that they do have legal rights. The family of any person who died because of a motorcycle malfunction may be able to pursue some measure of accountability and transparency through a wrongful death claim.
