Liability for Accidents Involving Consumer Products
A large number of fires have been started by defective consumer products. This is particularly common with products that contain lithium-ion batteries. According to the National Fire Protection Association, “Since 2022, New York City has experienced more than 800 fires sparked by lithium-ion batteries, leading to 30 deaths and more than 400 injuries. Lithium-ion batteries have been the third-leading cause of accidental fires across New York City in each of the past two years, trailing only electrical wiring and smoking.” There are several potential defects with a product that could contribute to a fire hazard.
- A consumer product could have faulty wiring that causes arcing or short circuits.
- A consumer product may have defects with its own batteries that overheat or enter thermal runaway.
- A consumer product may have poor insulation, thereby allowing heat to escape and reach materials that are flammable.
- A consumer product may have inadequate shielding between hot components and the overall plastic housing of the unit.
A product manufacturer could potentially be liable for an injury involving a consumer product if that product was defective in some way. Product defects are inherent to the way that a product exists and are present before it is manufactured. Companies should routinely test their products and all of the ways that they will likely be used and even misused. If a person is injured by a defective product that causes a fire, there are many reasons they should consider hiring an attorney.
- An attorney can help preserve key pieces of evidence.
- An attorney can help identify all liable parties.
- An attorney can help recover damages for medical bills and lost wages.
- An attorney can negotiate with insurance providers to ensure you are fairly compensated.
The vast majority of accidents involving consumer products are totally preventable. They tend to involve companies that are choosing to forego safety measures. This can include using lower quality materials to manufacture their products. It is important that accident victims understand that they do have legal rights. They are able to seek some measure of accountability and justice through a personal injury claim. A product liability attorney can examine the unique facts of your case and let you know what your legal options are.
