$6 million settlement awarded to union operating engineer injured by a falling steel stud

A second-year female union operating engineer apprentice who was hired to inspect concrete on a construction site was injured when a steel beam fell off the building striking a truck and then bouncing off it and striking her head and shoulder.

Our client sustained a concussion and persistent myofascial shoulder pain due to being hit in the shoulder. While the defendant admitted liability, they put on extensive evidence that the concussion completely healed during the trial and that that none of plaintiff’s injuries could be documented through any testing.  The case was tried for 2 weeks and settled during trial.

Clifford Horwitz, lead attorney for Horwitz, Horwitz & Associates, along with Partner David Starshak, and Trial Attorney Gabe Drury negotiated a favorable settlement, awarding the injured worker $6 million. All other details regarding the case remain confidential.
