A Local 1 Union Iron Worker recovered $2.38 million after suffering an injury that effectively ended his career.
The ironworker was working on a beam without fall protection when the load carried by the crane came into contact with the beam causing the ironworker to fall.
The defendant was the general contractor, Joseph J. Duffy company. The defendant argued that the ironworker was highly experienced and therefore should have tied himself off. The lead trial team at Horwitz, Horwitz & Associates alleged that the defendant failed to provide adequate fall protection and that there was no safe place to tie off.
