Liability for Will County Truck Accidents

Truck drivers are expected to obtain a commercial license and operate their vehicles with a great deal of caution to avoid collisions. They must drive at a safe speed at all times. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-601, “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway, or endangers the safety of any person or property.” Truck drivers should take several measures to avoid collisions. Truck drivers should take several other actions to prevent an accident.

  • Rest Breaks: Truck drivers are required to take periodic rest breaks and limit the number of hours that they work in any given day.
  • Blind Spots: Truck drivers are required to check their blind spots before turning at an intersection or changing lanes.
  • Vehicle Maintenance: Truck drivers are required to ensure that their vehicles are in working order. They must report any issues that they encounter.

Accidents with commercial trucks can be highly complex events. Liability may extend to several other parties. This includes the company that owned or operated any commercial truck. Business owners can be liable for the wrongful actions of their employees who are operating within the course and scope of their job duties. It is also possible that liability could be shared among several drivers, which is why it is so important that the circumstances leading up to any collision are properly understood.

Steps to Take After Will County Semi-Truck Accidents

Trucks are involved in many serious collisions every year in the United States. According to the Federal Motor Carrier Safety Administration, “In 2022, 6,050 large trucks and buses were involved in fatal crashes, a 2-percent increase from 2021. From 2021 to 2022, large truck and bus fatalities per 100 million vehicle miles traveled by all motor vehicles stayed the same at 0.192, 6 percent below the 21st-century peak of 0.205 in 2000.” Several actions should be taken after any accident involving a commercial truck.

  • Police Report: The police should be called to the scene as soon as possible so that they can begin an investigation into the cause of the collision.
  • Evidence Preservation: All of the physical evidence related to the crash should be carefully documented and preserved.
  • Witness Statements: Any person that may have witnessed the collision should be asked to give a statement. This should ideally be done earlier while people’s memories are still fresh.
  • Independent Review: Truck accidents should be independently reviewed by a team with ample experience in tort claims. This team can help subpoena records and gain access to information that is critical to establishing liability.

Truck accidents are often highly preventable. They tend to involve clear safety lapses. Truck companies may push their drivers to complete their routes on unrealistic time schedules. These same companies will then not accept responsibility when one of their drivers causes an accident. It is important that victims of truck accidents understand that they do have rights. These rights extend to the family member of any person who dies in a truck accident. They are able to seek some measure of accountability and justice through a civil action.
