OSHA Investigation Underway After Worker Fell From Scaffolding at Construction Site on Water’s Edge Drive in Crystal Lake

CRYSTAL LAKE, ILLINOIS (December 28, 2025) – A construction worker was seriously injured in Crystal Lake after falling from a scaffold at a worksite on Waters Edge Drive.
Crystal Lake officials are saying that the accident took place around 1:00 PM on Wednesday. A construction worker fell roughly six feet from a scaffold.
Firefighters and paramedics were called to the scene of the accident to help the victim. He was transported in a LifeNet medical helicopter to a local trauma center.
The accident took place in Water’s Edge, which is part of the former Crystal Court Shopping Center. A full investigation into the scaffold accident remains ongoing.
Liability for Illinois Scaffold Accidents
Employers in Illinois have a legal obligation to maintain their worksites in a safe condition and to protect workers from reasonably foreseeable sources of harm. Pursuant to 29 U.S.C. § 654(a)(1), “Each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.” Construction companies should take several measures to protect workers from scaffold falls.
- Fall Protection: Construction companies should install fall protection in certain locations. This can include guardrails and safety nets.
- Safety Equipment: Construction companies should provide their workers with personal fall arrest systems (PFAS).
- Inspections: construction companies should ensure that their scaffolds are inspected by a competent person before each shift.
- Training: Construction companies should provide all of their workers with ample training on the proper use of harnesses and connectors when working on scaffolds.
When a worker is injured in Illinois, they will typically have recourse to the workers’ compensation system. This is a no-fault insurance team designed to help injured workers. There is no need for an injured worker to demonstrate one party was liable. In addition to workers’ compensation, an injured worker may have recourse to a third-party liability claim. A third-party liability claim may be possible if an entity separate from the worker’s employer contributed to an accident. There could be numerous sources of third-party liability for a scaffold accident, including general contractors and the company that constructed the scaffold.
Steps to Take After Illinois Scaffold Accidents
Falls remain one of the leading causes of preventable injury and death for construction workers in the United States. According to OSHA, “An estimated 2.3 million construction workers, or 65 percent of the construction industry, work on scaffolds frequently. Protecting these workers from scaffold-related accidents would prevent 4,500 injuries and 50 deaths every year, at a saving for American employers of $90 million dollars in workdays not lost.” Several steps should be taken after any construction worker is injured in a scaffolding accident.
- Treatment: Victims should seek medical treatment as soon as possible. Many of the injuries associated with scaffold accidents will not be immediately obvious.
- Medical Records: All of the medical records related to the accident should be collected.
- Safety Records: All of the safety records related to the accident should also be reviewed. They can help reveal systemic issues that may have contributed to a scaffolding accident.
- Legal Review: Any person injured in a scaffold accident should seek the guidance of an experienced personal injury attorney.
It can be difficult to know where to begin after being injured in a scaffold accident. Victims are often left with high medical bills and may need to take extensive periods of time away from work. It is important that victims understand that they do have legal options. They may be able to pursue additional sources of recovery through a personal injury claim. A personal injury attorney can examine the unique facts of your case and let you know what your legal rights are.
