Liability for Huntley Semi-Truck Accidents

Truck drivers are required to obtain a commercial license and must operate their vehicles with an abundance of caution to avoid collisions. They must maintain a safe distance from vehicles ahead of them. According to Illinois Vehicle Code 625 ILCS 5/11-710, “The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon and the condition of the highway.” There are many ways that a truck driver may have acted negligently prior to a collision.

  • Lane Changes: A truck driver may have made an unsafe lane change into the path of another vehicle.
  • Left Turn: A truck driver may have turned left into the path of another vehicle without checking their blind spots.
  • Distractions: A truck driver may have been paying attention to their phone or some other object before a collision.

When a truck driver fails to slow down to avoid hitting another vehicle, this could serve as evidence of negligence. Liability for a truck collision could involve several different entities. This includes the company that owned or operated trucks. Under Illinois law, vehicle owners can be liable for accidents when they allow another person to operate that vehicle. The company responsible for maintaining a truck or other vehicle could have some level of responsibility for a collision as well.

Steps to Take After Huntley Semi-Truck Accidents

A fully loaded semi-truck can weigh 80,000 lbs. Given the size and weight of these vehicles, they can be incredibly dangerous at freeway speeds. According to the IIHS, “Most deaths in large truck crashes are passenger vehicle occupants. The main problem is the vulnerability of people traveling in smaller vehicles. Trucks often weigh 20-30 times as much as passenger cars and are taller with greater ground clearance, which can result in smaller vehicles underriding trucks in crashes.” Many different actions should be taken after any semi-truck accident.

  • Police: The police should be called to the scene so that they can begin investigating. Any report that they create will be enormously useful later on.
  • Surveillance: Any surveillance footage that may have been captured should be sought.
  • Event Data Recorder: The event data recorder for any truck involved in the collision should be reviewed. This device will contain valuable information about how a truck was being handled prior to a collision.
  • Independent Review: Determining liability for any truck accident will require a careful review of the facts. The family of any person who dies in a semi-truck accident should request a free investigation into the crash with a team experienced in accident reconstruction and negligence claims.

Truck accidents tend to be very preventable. Part of the problem is that many truck companies push their drivers to complete routes as quickly as possible. This can lead truck drivers to adopt unsafe driving practices. It is important that the victims of truck accidents understand they do have legal rights. The family of any person who died due to the negligent actions of a truck driver is able to seek some measure of accountability through a civil action.
