33-Year-Old Pedestrian Killed in Accident With Commuter Train Along East Nine Mile Road in Ferndale

FERNDALE, ILLINOIS (March 19, 2026) – A pedestrian has tragically died in a Ferndale commuter train accident by East 9 Mile Road near Hilton.
Ferndale police officials are saying that the accident took place around 3:30 PM on Wednesday. A commuter train was involved in a collision with a pedestrian near the train tracks.
Investigators claimed that the railroad tracks were operating properly at the time of the collision. Despite life-saving measures, the pedestrian died due to their injuries.
A full investigation into the crash remains ongoing.
Liability for Ferndale Train Accidents
Train operators have a legal obligation to use caution to avoid collisions with pedestrians and other vehicles. They must continuously scan the tracks ahead of them for potential hazards. Trains have speed limits in much the same way vehicles do. If a train operator fails to slow down to avoid hitting any pedestrian in the roadway, this could serve as evidence of negligence. Train companies should take several measures to avoid pedestrian accidents.
- Train conductors should use their horns in urban areas that have lots of traffic as they pass through crossings.
- Trains should be periodically inspected and well maintained.
- Trains should slow down in areas that have dense traffic or blind spots.
Depending on the facts of any case, liability for any train accident may extend beyond a person conducting a train or their employer. The company or municipal entity responsible for a set of train tracks could also be liable for a collision. Property owners in Illinois have a legal obligation to maintain their premises in a relatively safe condition. This necessitates that train tracks have crossing arms and gates that function properly and that are unobstructed by vegetation or other potential hazards.
Steps to Take After Ferndale Train Accidents
Many pedestrians are killed or seriously injured in train accidents each year in the United States. According to the National Safety Council, “From 2023 to 2024, fatalities at highway-rail crossings increased 7%, while fatalities involving other types of incidents decreased 4%. The latter included 663 deaths (96%) attributed to trespassers. Eight employees were killed while on duty, up slightly from the 2023 total of seven.” Several steps should be taken after any train accident.
- The police should be called to the scene to investigate.
- Any person who may have witnessed the collision should be interviewed.
- Medical records related to the crash should be preserved.
- The family of any person who died should seek an independent review by a team experienced in accident reconstruction.
Train accidents are often highly preventable. Law enforcement tends to be quick to blame pedestrians and drivers for any collision. But the fact of the matter is that many of these incidents involve liability on the part of train conductors. Unsafe conditions on train tracks are another major problem. The family of any person who died in a train accident may be able to seek some measure of justice through a wrongful death claim.
