Liability for Gurnee Roof Fall Accidents
Falls remain one of the leading causes of preventable injury and death for construction workers. According to the Bureau of Labor Statistics, “In 2023, about 1 in 5 (20.8 percent) workplace deaths occurred in the construction industry and 38.5 percent of these deaths were due to falls, slips, and trips. The construction industry accounted for 47.8 percent of all fatal falls, slips, and trips in 2023.” Construction companies should take several measures to prevent falls.
- Fall Arrest Systems: Workers should be provided with personal fall arrest systems when they’re working at a height of 6 feet or more from a lower surface.
- Training: Workers should receive adequate training to understand how to avoid falling in certain situations.
- Guardrails: Worksites may need protective guardrails to help mitigate the risk of falling.
When a worker is injured in a fall in Illinois, they will typically have recourse through the workers’ compensation system. This is a no-fault insurance scheme designed to help injured workers. There is no need for an injured worker to demonstrate that one party acted negligently prior to an accident. In addition to workers’ compensation, an injured worker may be able to pursue some measure of accountability through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident. There could be numerous sources of third-party liability for roof fall accidents.
- General Contractor: A general contractor could be liable for roof fall accidents if they failed to maintain a worksite in a reasonably safe condition.
- Property Owner: A property owner could also be liable for an accident if a walking surface on their property were defective or dangerous in some way.
- Equipment Manufacturer: The company that manufactured a piece of safety equipment may be liable for an accident if that safety equipment failed.
Roof falls tend to be highly preventable in the construction industry. They tend to be the results of overlooked safety measures. In particular, workers may not be provided with fall protection. Workers may be asked to work on surfaces that are slick. It is vital that construction companies adhere to all OSHA safety regulations designed to mitigate fall risk. The family of any person who died in a roof fall accident may be able to pursue some measure of accountability through a wrongful death claim.
