The laborer required back surgery for a herniated disk and shoulder surgery for a torn rotator cuff and was released to return to work with only a 20 pound lifting restriction which precluded him to returning to work as a laborer.
Clifford Horwitz, lead trial attorney, claimed that the pre-cast showed cracks that should have been seen and therefore removed by the general contractor. In addition, Horwitz also claimed that the masonry company poured the wall improperly.
Both companies contributed to pay the settlement, through their respective insurance companies.
