While the carpenter was working with bands to strengthen himself, the machine pulled itself out of the wall. The carpenter required back surgery due to the accident.
The physical therapy facility argued that they could not have discovered that this product would pull out of the wall.
Clifford Horwitz proved that the product was improperly placed in the wall in the first place and it was foreseeable that it would pull out of the wall eventually.
