Liability For Chicago Transit Authority Bus Accidents

Accidents involving Chicago Transit Authority buses remain alarmingly common. According to ABC 7, “For CTA buses, that crash factor is 36 hours. Every day and a half in Chicago, a city bus is involved in a crash and the I-Team discovered a surprising number of injuries in CTA accident reports.” Bus companies should take a number of measures in order to avoid bus accidents.

  • Bus companies should ensure that all of their drivers are well trained.
  • Buses should be regularly inspected and properly maintained.
  • Bus companies should eliminate as many left-turns from their routes as possible.

Public buses are considered “common carriers” under the Common Carrier Liability Act (740 ILCS 25/).  Their drivers must operate with an abundance of caution in order to avoid collisions. This includes slowing down in order to avoid hitting pedestrians and other vehicles. If a bus driver fails to slow down in order to avoid a collision, this could form the basis of a negligence claim.

When a bus driver causes a collision, their employer could be held at fault. This could include a private company or a municipal entity like Chicago that operates a bus agency. In general, employers are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. This would include instances where a bus driver was transporting passengers. Victims of bus accidents tend to suffer very serious injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Bus accidents are typically complex events. They tend to involve several factors, including poor weather, speeding, and safety violations. It is important that accident victims understand that they do have rights after any incident. They may be able to seek some level of accountability through a civil claim.
