Liability For East Peoria Pedestrian Accidents
Thousands of pedestrians are killed or seriously injured in car accidents every year. According to Patch, “In 2010, 4,302 pedestrians were killed in traffic collisions, accounting for 13 percent of all traffic deaths. By 2021, pedestrian deaths accounted for nearly 18% of all traffic deaths, according to the GHSA report.” There are many factors that could contribute to a pedestrian collision.
- Distracted driving
- Inclement weather
- Poor road conditions
- Dangerous left turns
All drivers have a legal obligation to exercise due care to avoid collision with any pedestrian or cyclist in the roadway. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horn when necessary and exercise the proper precaution to avoid colliding with any child or obviously confused person. If a driver fails to slow down and hits a pedestrian, this could form the basis of a negligence claim. Several steps should be taken after any car accident.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- A thorough investigation should be conducted.
The vast majority of pedestrian collisions are avoidable and involve some amount of driver error. In particular, many drivers fail to check their blind spots and hit pedestrians as they are driving. The family of any person that died in a pedestrian collision may be able to seek accountability through a civil claim. Evidence will be crucial in demonstrating liability for any collision.
