Baby Died Following Incident at House of Children Daycare in Woodstock

Baby Died After Being Found Unresponsive at House of Children Daycare Along Harding Lane in Woodstock

WOODSTOCK, ILLINOIS (May 9, 2026) – A four-month-old baby has tragically died after being found unresponsive at the House of Children daycare in Woodstock.

Woodstock police officials are saying that the incident took place around 10:45 a.m. on Tuesday. A baby was found unresponsive and not breathing while at the House of Children daycare.

Staff at the business began providing medical assistance. Paramedics were also called to the scene to help the child.

Emergency crews were eventually able to stabilize the child before they were transported in an ambulance to a local hospital. That child was later airlifted to another hospital to receive advanced treatment.

Despite those efforts, that child later was pronounced dead. A full investigation into the incident at the House of Children daycare remains ongoing.

Liability for Woodstock Daycare Accidents

Daycare providers have a legal obligation to protect all of the children in their care from reasonably foreseeable sources of harm. This necessitates that daycares properly supervise all of the children in their care at all times. Younger children will typically need much greater levels of supervision. Daycare should also take several other measures to prevent the children in their care from being injured.

  • Ratios: Daycares should maintain adequate staff-to-child ratios at all times.
  • Childproofing: Daycares should cover outlets, secure cabinets, and take additional steps to prevent children from accessing unsafe areas.
  • Maintenance: Daycares should ensure that all of their equipment is routinely inspected and well maintained.
  • Training: Daycares should have staff that are trained in CPR and emergency preparedness.

If a daycare employee fails to adequately supervise a child who was injured, this could serve as evidence of negligence. Their employer could also be vicariously liable for the incident. In general, employees in Illinois can be vicariously liable for the negligent conduct of their workers who were operating within the course and scope of their job duties. A large portion of daycare accidents involve workers who are not sufficiently attentive to children.

Steps to Take After Woodstock Daycare Accidents

Far too many children are seriously injured or killed every year in preventable daycare accidents. According to one study in the National Institutes of Health, “Recent studies have suggested that day care may be a relatively unsafe environment. In this population-based study, the incidence of injuries in day care and home care were evaluated based on the number of hours children were exposed to each environment.” Multiple steps should be taken after any daycare accident.

  • All of the medical records related to the incident should be collected.
  • The history of safety violations at the institution in question should be understood.
  • Any person who may have witnessed what happened should be interviewed as early as possible, while their memories are still fresh.
  • The parents of any child injured in a daycare should seek the legal guidance of a team experienced in negligence claims.

Daycare accidents are often highly preventable. They tend to involve situations where daycare employees are not adequately supervising children. One of the major issues at many daycares is that there are simply not enough workers to properly supervise all of the children being looked after. The family of any child injured in a daycare accident is able to seek some measure of accountability and transparency through a civil action.
