Liability for Madison County Bicycle Accidents
Drivers have a legal obligation to exercise due care to avoid any pedestrian or bicycle in the roadway. They must be particularly cautious when making left turns. Pursuant to Illinois Statutes Chapter 625. Vehicles § 5/11-90, the driver of any vehicle intending to turn left must first yield the right-of-way to any vehicle traveling from the opposite direction that is close enough to pose a hazard. There are many potential causes of car accidents involving bicyclists.
- Blind Spots: Drivers may fail to examine their blind spots before making turns at intersections.
- Obstructed View: Drivers may have their view of an intersection, obstructed by foliage, fixed objects, or rays from the sun.
- Distracted Driving: Drivers may be distracted by their cellphones or other objects.
Bicyclists have all the rights and obligations of drivers. If a driver makes a left turn into the path of a bicyclist, this could form the basis of a negligence claim. Depending on the facts of any case, there could be numerous liable parties for any accident. In particular, a city or other municipal entity could be liable for a collision if it was caused by a dangerous condition on public property.
Steps to Take After a Madison County Bicycle Accident
Thousands of people are killed or seriously injured every year in bicycle accidents. According to the IIHS, “There were 7,314 pedestrians and 1,155 bicyclists killed in 2023 and approximately 68,000 pedestrians and 49,000 bicyclists injured in motor vehicle crashes on public roadways in the United States. Pedestrians comprised about 18% of crash deaths, and bicyclists made up an additional 3%.” Several steps should be taken after any bicycle accident.
- Police: The police should be called to the scene so they can begin an immediate investigation.
- Medical Attention: Victims should seek medical attention as early as possible, even if they feel as though they are all right.
- Eyewitnesses: Victims should get the contact information of any eyewitnesses.
- Legal Support: Any person injured in a bicycle accident should seek the guidance of an experienced Illinois bicycle accident attorney.
The vast majority of bicycle accidents are preventable. They tend to involve situations where drivers are not paying adequate attention to the road ahead of them. Unfortunately, drivers and their insurance providers will almost never accept responsibility for any collision. This is why it is so important for victims to speak with an attorney about their unique situation. Any person injured in a Wood River Bicycle accident may be able to seek some measure of accountability through a personal injury claim.
