Liability for Aurora Bicycle Accidents
Drivers have a legal obligation to slow down to avoid colliding with any pedestrian or cyclist in the roadway. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, “every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian, or any person operating a bicycle or other device propelled by human power and shall give warning by sounding the horn when necessary and shall exercise proper precaution upon observing any child or any obviously confused, incapacitated or intoxicated person.” Drivers should take several actions to avoid hitting pedestrians.
- Drivers should check their blind spots before making turns at intersections.
- Drivers should continue to scan the road ahead of them for pedestrians and other potential hazards.
- Drivers should abstain from alcohol and other intoxicating substances.
- Drivers should ensure that their vehicles are periodically inspected and well maintained.
If a driver fails to slow down to avoid colliding with any cyclist in the roadway, they could be liable for the collision through a civil claim. Depending on the specific facts of any case, liability for pedestrian accidents could extend beyond any specific driver. For example, a city could bear some level of responsibility for a car accident if it was caused by some type of dangerous condition in the roadway.
Common Injuries Associated With Bicycle Accidents
Many cyclists are killed or seriously injured every year in motor vehicle collisions across Illinois and the United States. According to the National Safety Council, “The number of preventable deaths from bicycle transportation incidents increased by 1% in 2023 and 53% in the last 10 years (from 902 in 2014 to 1,377 in 2023). The number of preventable nonfatal injuries also increased by 1% in 2023 but has declined by 29%, from 480,212 in 2014 to 341,774 in 2023.”Victims of bicycle accidents tend to suffer very serious injuries.
- Broken bones
- Lacerations
- Spinal cord injuries
- Organ damage
Even after a person’s physical injuries heal following an accident, many victims are left with long-term psychological injuries. These can manifest through anxiety, depression, and post-traumatic stress disorder. Unfortunately, drivers and insurance providers will almost never accept responsibility when a cyclist is seriously injured in a crash. Any person injured due to the negligent actions of another driver may be able to receive some measure of accountability through a civil claim.
