Liability for Cook County Truck Accidents

Thousands of people are killed or seriously injured in car accidents across the United States and Illinois. According to the National Highway Traffic Safety Administration, “In recent years we have seen decreasing motor vehicle crash fatalities in Illinois, including an all-time-Illinois low in 2009, but fatalities have increased significantly in 2020 and 2021. Overall, traffic fatalities in Illinois have decreased from 1,454 in 2003 to 1,334 in 2021.” Commercial trucks can be particularly dangerous. There are a number of measures that truck drivers should take in order to avoid accidents.

  • Truck drivers should check their blind spots before making turns.
  • Truck drivers should continuously scan the road ahead of them for pedestrians and other hazards.
  • Truck drivers should ensure that their vehicles are routinely inspected and well-maintained.
  • Truck drivers should use their horns when necessary to alert pedestrians of their presence.

Truck drivers are required to get a commercial driver’s license. They are held to a high standard in terms of safety. All truck drivers must operate with an abundance of caution in order to avoid any pedestrians in the roadway. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. If a truck driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim.

There could be several liable parties for any truck accident. This may include the company that a truck driver worked for. In general, employers are liable for the wrongful actions of their employees—insofar as those employees were working within the course and scope of their job duties. For example, a truck driver may have been transporting goods when they were involved in a collision. It is important that the circumstances of any truck accident are properly understood.

  • It should be determined if the truck driver involved in the accident had a history of safety violations.
  • The truck driver’s logbook should be reviewed.
  • Surveillance footage from nearby traffic cameras and businesses should be collected.
  • Medical records related to the crash should be examined.

Even in the absence of any footage of an accident, medical records can paint a clear picture of what took place. This is true even when truck drivers attempt to deny liability after hitting a pedestrian. Most pedestrian accidents are avoidable. They tend to involve drivers who are speeding or otherwise distracted. Accident victims should be aware that they do have legal rights under the law. In particular, the family of any person who died in a truck accident may be able to seek some measure of accountability through a civil claim.
