Liability For Chicago Window Fall Accidents

Falls remain one of the main causes of childhood injury. According to Stanford Children’s Hospital, “It is estimated that more than 2.2 million children ages 14 and under are treated annually at hospital emergency rooms for fall-related injuries. Reports show falls kill about 100 children ages 14 and under every year.” Windows can be particularly hazardous. There are a number of steps that can be taken to help prevent children from falling out of windows.

  • Landlords should install guards on windows at apartment units where small children are present.
  • Air conditioners should be installed with non-removable screws.
  • Windows should be equipped with devices that limit how far they can be opened.

Depending on the facts of any case, an apartment owner could face civil liability if any child is injured on their premises. Pursuant to Illinois Civil Code (740 ILCS 130/1), when a property owner has actual or constructive notice of a dangerous condition with their property, they must take action to correct this dangerous condition. If an apartment window was defective in some way prior to an accident, this could form the basis of a negligence claim. Victims of window falls tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

Even after a person’s physical injuries have healed, accident victims are often left with long-term psychological injuries. It can be hard to know where to begin after any accident at an apartment. But it is important for renters to understand that they do have rights. The family of any child injured at an apartment may have legal recourse through a civil claim. A premises liability attorney can examine all of the unique facts of your case and let you know what your legal options are.
