Intellio Toys Issues Recall of Bright Builder Fort Kits Over Concerns They Pose Battery Ingestion Hazard
CHICAGO, ILLINOIS (September 21, 2024) – Intellio Toys issued a recall of its Bright Builder Fort Kits over concerns that the toys may pose a battery ingestion hazard.
The recall was issued on September 12, 2024. Around 12,400 units were sold. According to the press release by the Consumer Product Safety Commission, the flashlight on the recalled kits violates safety standards for battery-operated toys.
In particular, the button cell batteries are in a compartment that can be easily opened without tools. If a child ingests the button cell batteries, this can cause serious internal injuries, including chemical burns and death.
Intellio Toys has received one report of the batteries coming out of the flashlight. However, no injuries have been reported at this time. The kit parts consist of bright blue tubes and neon green balls with holes.
Liability For Injuries Caused By Children’s Toys
Injuries involving children consuming batteries may seem like freak occurrences, but they are very common. According to John Hopkins Medicine, “Unfortunately, many children will place [button batteries] in their mouth. There has been an average of 3,500 button battery ingestions per year and the incidence has increased in the last decade.” There are a number of injuries that may come with ingesting button batteries.
- Esophageal burns
- Tissue necrosis
- Perforation of organs
- Hemorrhage
- Airway obstruction
Companies that make toys for children have a legal obligation to ensure that those toys are reasonably safe. In particular, they must comply with all safety standards for battery-operated toys. Among other things, these toys must have child-resistant battery compartments. These toys must also come with warning labels. If a toy company violates federal safety standards or fails to warn about the dangers of their products, this could form a product liability claim. Several steps should be taken after any injury involving a child toy.
- Medical records related to any injury should be preserved.
- It should be determined if the toy involved was part of any recall.
- An experienced product liability attorney should be contacted.
It can be hard to know what to do if your child is injured by a dangerous toy. Many of the injuries involved with battery ingestions may not manifest for long periods of time. Sadly, though, toy makers will often do everything in their power to deny liability when their toy injures a child. This is why it is so important for parents to seek legal support as early as possible.
