Liability For Chicago Uber Shootings

As Uber has continued to grow so to have the number of safety concerns with the platform. According to reporting by NBC News, “Uber received 3,824 reports of sexual assault and misconduct from 2019 through 2020, a 38% decrease from 2017 through 2018, the company said in its U.S. safety report Thursday.” Many other instances of Uber passengers being attacked by third parties have also been reported. There are a number of steps that Uber can take to prevent assaults.

  • All drivers should be thoroughly vetted before they start.
  • All reported instances of attacks or sexual assaults should be investigated.
  • Uber can adopt policies and procedures to limit assaults.

Depending on the facts of any case, Uber could potentially be liable if one of their passengers is attacked. Consider, for example, one lawsuit against Uber after a shooting in Clark County. A woman was shot by a third party after an Uber driver flashed a gang sign. One person outside of the vehicle opened fire on the Uber hitting the woman inside. There are a number of steps that should be taken after any attack involving an Uber.

  • Eye witnesses should be interviewed.
  • Medical records should be sought.
  • Surveillance footage should be reviewed.
  • A thorough, independent investigation should be conducted.

It can be hard to know where to begin after any attack in an Uber. But it is important for victims to know that they do have rights. The family of any person that is killed in an Uber may be able to seek some measure of justice through a civil claim. Sadly, though, Uber will often fight hard to deny liability for any incident.
