Liability for Lake County Car Accidents
All drivers in Illinois have a legal obligation to operate their vehicles with the care necessary to avoid collisions. According to Illinois Vehicle Code 625 ILCS 5/11-601, “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway, or endangers the safety of any person or property.” Drivers must be particularly cautious from passing through construction zones. There are a number of ways that a driver may have acted negligently in any car accident.
- A driver may have been distracted and looking at their cell phone.
- A driver may have been under the influence of prescription medications.
- A driver may have allowed their vehicle to drift on the shoulder of the road.
When a worker is injured in Illinois, they will typically have recourse through the workers’ compensation system. This is a no-fault insurance scheme designed to help injured workers. Workers may also be able to pursue damages through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributed to an accident. This could include other drivers that are separate from a worker’s employer.
Steps to Take After Illinois Car Accidents
Motor vehicle collisions remain one of the leading causes of preventable injury and death for workers in the United States. According to the Centers for Disease Control, “Of the 2,523 workers fatally injured in traffic-related motor vehicle crashes, 93% were male. The injury rate for male workers was 11 times that for female workers (1.2 compared with 0.1 per 100,000 workers).” It is important that certain actions are taken after any workers are injured in a car accident.
- Victims should seek a thorough medical evaluation.
- Victims should let their doctors know that they were injured on the job.
- Victims should see if they qualify for workers’ compensation.
- Victims should consult with an experienced personal injury attorney.
Car accidents are routinely one of the most difficult and traumatic experiences. The most people will ever go through. Many victims are left with long-term injuries that impair their ability to work or even perform daily tasks. To make matters worse, drivers and their insurance providers will virtually never accept responsibility if they cause an accident. Any person injured in a car accident may be able to pursue damages through a personal injury claim.
