Daruisz Zalewski Killed In Bensenville Tow Truck Accident

BENSENVILLE, ILLINOIS (August 5, 2023) – A Des Plaines man identified as Daruisz Zalewski has tragically died in a Bensenville tow truck accident.

DuPage County officials are saying that the accident took place around 10:14 p.m. on Monday. A tow truck driver hit Daruisz Zalewski as he was riding a motorcycle in a parking lot.

The driver of the tow truck fled the scene. Paramedics were called to the scene in order to help the victim. Daruisz Zalewski was unresponsive and lying next to his motorcycle.

He was taken to the hospital with critical injuries where he later died. Police arrested the tow truck driver involved in the crash at his home.

Liability For Bensenville Motorcycle Accidents

Motorcyclists are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the IIHS, “Fatalities among motorcycle riders and passengers increased 11% from 2019 to 2020, while the rate per 100 million vehicle miles traveled increased by 23%.” There are a number of steps that drivers should take in order to avoid hitting motorcyclists.

  • Drivers should check their blind spots before making turns.
  • Drivers should signal to alert others of their attentions.
  • Drivers should dramatically slow down in parking lots.

All drivers have a legal obligation to exercise due care in order to avoid hitting other vehicles. Many collisions are due to drivers that make dangerous left turns. Pursuant to Illinois Vehicle Code (625 ILCS 5/11-902), any person intending to turn left must first yield the right of way to any vehicle traveling from the opposite direction that is close enough so as to pose a hazard.

If a tow truck driver was working at the time of a collision, their employer could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. There are a number of steps that should be taken after any tow truck accident.

  • Eye witnesses should be interviewed.
  • Surveillance footage should be sought.
  • Photos of the accident should be taken.
  • A thorough investigation should be conducted.

If a driver flees the scene of a collision, they could face both civil and criminal liability. There is simply no reason that a driver should ever leave the scene of an injury collision. The family of any person that died in a hit-and-run accident may be able to seek some measure of justice through a wrongful death claim. Sadly, though, it is common for drivers to deny all liability if they are involved in a fatal collision.
