Liability for McHenry County Car Accidents
E-bikes have continued to grow in popularity over the years. This has led to a sharp increase in the number of e-bike accidents. According to the CSPC, “Micromobility Products-Related Deaths, Injuries, and Hazard Patterns, released today by the U.S. Consumer Product Safety Commission (CPSC), shows that injuries associated with all micromobility devices increased nearly 21% in 2022 from 2021. Micromobility-related injuries have trended upward since 2017, increasing an estimated average 23% annually.” There are many reasons that drivers may hit e-bikes.
- Many e-bike collisions involve drivers that are intoxicated.
- Speeding is another substantial cause of these accidents.
- Motorcycles and e-bikes have a naturally small profile and are more likely to be overlooked by other drivers.
All drivers have a legal obligation to use caution in order to avoid causing accidents. Many collisions involved drivers that were making dangerous left turns in the roadway. Pursuant to 625 ILCS 5/11-801, the driver of a vehicle intending to turn left must first yield the right-of-way to all traffic that is close enough so as to pose a hazard. When a driver makes a left turn into the path of another vehicle, this may be construed as negligence.
Depending on the facts of any case, liability for any e-bike collision could extend beyond any driver. Many car accidents involve vehicles that are being used for commercial purposes. This is especially common for collisions involving pickup trucks and vans. If the driver of a vehicle was working at the time of collection, their employer could potentially be held at fault. As a general rule, employers are vicariously liable for the wrongful actions of their workers. Victims of e-bike collisions tend to suffer very serious injuries.
- Head injuries
- Complex fractures
- Organ damage
- Lacerations
- Burn injuries
Even after the physical injuries of a car accident heal, many victims report long-term psychological trauma. This can often manifest through anxiety, depression, and post-traumatic stress disorder. It is important for accident victims to understand that they do have legal rights. Any person injured due to the negligence of another driver may be able to seek some measure of accountability through a civil claim. A personal injury attorney can evaluate the unique facts of your case free of cost and let you know what your options are.
