Fisher-Price Recalled Dumbbell Toy In Baby Biceps Gift Sets Due To Choking Hazard

CHICAGO, ILLINOIS (September 12, 2024) – Toy manufacturer Fisher-Price has issued a recall for its popular Dumbbell Toy sold as part of the Baby Biceps Gift Sets.

The recall was first issued on August 29, 2024. Around 366,000 units were sold, including over 37,000 sold in Canada. Fisher-Price received seven reports of the dumbbell coming off.

When the dumbbells come off, this could pose a choking hazard for children. No reports of injuries have been made thus far.

The toys were manufactured in China and Vietnam.

Liability For Injuries Involving Consumer Products

Many children are injured after choking on toys or other consumer products every year. According to the Consumer Product Safety Commission, “Each year, CPSC receives about 15 reports of choking deaths to children under age 3. Some of these deaths involve items that are considered known hazards such as small toys, toy parts, balloons, balls and marbles. In addition to known hazards, such as balloons, there are many tragic deaths each year that result from hidden hazards.” Companies should take a number of measures in order to ensure that their toys do not become choking hazards.

  • Companies should ensure that their toys are made of durable, non-toxic materials that won’t easily break into small pieces.
  • Companies should ensure that toys and toy parts for children under three are large enough to prevent them from being ingested.
  • Companies should ensure that they are compliant with all safety standards set by the Consumer Product Safety Commission.

All companies that make toys have a legal obligation to prevent them from becoming choking hazards. When a company makes a toy that becomes a choking hazard, this could form the basis of a product liability claim. A company could also be liable for failing to warn parents that their product could be a choking hazard for certain age groups. It is important that certain steps are taken after an injury involving a childhood toy.

  • Medical records related to the incident should be preserved.
  • It should be determined if the toy is part of a recall.
  • An experienced product liability attorney should be contacted.

Companies will often go to great lengths to deny responsibility when a child is injured by one of their products. In many situations, they may blame the parents. Part of the problem is that many companies that make children’s toys or products fail to warn parents about the potential hazards of those products. The family of any injured person who is injured after choking on a toy or other device may be able to seek some measure of justice through a civil claim.
