Liability For Alexander County Truck Accidents
There are many different factors that could contribute to a semi-truck accident. According to the FMCSA, “Elements that influence the occurrence of a crash may take place hours, days, or months before the crash. They include driver training and experience, vehicle design and manufacture, highway condition and traffic signaling, and weather conditions.” There are many steps that truck drivers should take in order to prevent collisions.
- Truck drivers should be well rested before the start of their shift.
- Truck drivers should use commercial GPS software.
- Truck driver should slow down during periods of inclement weather.
School buses are considered common carriers under the Common Carrier Liability Act (740 ILCS 25/). They must operate with the highest degree of care and the vigilance of a very cautious person. Many school bus collisions occur when bus drivers make unsafe maneuvers or lose control of their vehicle. It is extremely important that all evidence is properly preserved after any collision in order to determine negligence.
- Surveillance footage should be sought.
- Medical records should be preserved.
- Eye witnesses should be interviewed.
- A thorough investigation should be conducted.
Many victims of bus accidents tend to suffer very serious injuries. These injuries may not be immediately apparent for some time after any collision. Any person that is injured in a bus accident may have legal recourse through a civil claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, bus companies and truck companies will often do everything that they can to deny liability for any collision.
