KTM Issues Recall for GASGAS and Husqvarna Off-Road Motorcycles Due to Issues With the Brake Calipers
CHICAGO, ILLINOIS (May 28, 2025) – KTM has issued a recall for the GASGAS and Husqvarna Off-Road Motorcycles because they can potentially pose a crash hazard during use.
The recall was issued on May 15, 2025. Approximately 19,310 units were sold prior to the recall.
According to the Consumer Product Safety Commission, the front brake caliper may crack. This can reduce the effectiveness of the braking system and possibly lead to a crash.
No injuries have been reported at this time.
Liability for Injuries Caused by Faulty Brake Calipers
Accidents involving faulty brakes remain remarkably common. According to one estimate, “Approximately 2% of all vehicle crashes in the United States are due to a critical vehicle defect. Of this 2%, 22% of crashes are attributed to a brake malfunction. In 2022, brake-related recalls accounted for 6% of the total vehicle recalls.” Several factors could potentially contribute to an accident where brakes malfunction.
- Mechanical Failures: Brakes may experience mechanical failure if the brake pads are too thin.
- Leaking Brake Fluid: Hydraulic brake systems rely on fluid pressure in order to operate. Any type of leak in this system could lead to partial or complete brake failure.
- Brake Lines: Any type of air in brake lines can lead to them being less responsive and effective.
Companies have a legal obligation to create products that are reasonably safe. They must take into consideration the way that their products could degrade over time and with use. Part of creating a safe product is testing it in all of the real-world scenarios that will likely be used. If a product has designed defects that likely contribute to an accident, this could form the basis of a strict product liability claim.
Several lawsuits have been filed by people who have been injured due to faulty brake calipers. Consider, for example, Hasson v. Ford Motor Co. (1977). A college freshman was seriously injured in an accident after using his father’s 1966 Lincoln Continental. The brakes on the vehicle allegedly failed due to fluid vaporization. The court ultimately held that there was enough evidence for a jury to find that this was the proximate cause of the plaintiff’s injuries. It is important that certain actions are taken after any accident involving a motor vehicle.
- All medical records related to injuries should be preserved.
- It should be determined if the affected product was on any recall list.
- The product involved should be stored in a safe place or is not likely to cause further harm.
- An experienced product liability attorney should be contacted.
The vast majority of accidents involving defective products are completely preventable. These incidents tend to involve situations or companies that choose to take safety shortcuts in order to save money. Another major issue is that certain products get imported into the US market from territories that may not have as strict safety standards. Any person that is injured by a faulty product may be able to seek some measure of accountability through a civil claim.
