Horwitz Attorney Marc Perper Wins Supreme Court Victory for Illinois Labor

 

Injured Worker Rightfully Paid

After fighting the employer and their insurance carrier at every level, Horwitz, Horwitz & Associates has won a solid victory for working people throughout the State of Illinois.

The employer, Interstate Scaffolding, fired the injured worker, Jeff Urban, and then refused to pay benefits, claiming that Mr. Urban had been fired “for cause.”

Horwitz attorney Marc A. Perper convinced the Illinois Supreme Court to reverse this decision and force the employer to pay the injured worker his benefits.

The Illinois Supreme Court agreed to review the case, and on January 22, 2010, the Court reversed the appellate court’s decision and reinstated Mr. Urban’s award of TTD benefits.

The court stated, “an employer’s obligation to pay TTD [Workers’ Compensation] benefits to an injured employee does not cease because the employee [was] discharged—whether or not the discharge was for ‘cause.’”
