Liability for Injuries Caused by Children’s Toys
Many children are injured by toys every year in the United States. According to the Consumer Product Safety Commission, “An estimated 209,500 toy-related injuries were treated in U.S. hospital emergency departments in 2022, and males accounted for 54 percent of the injuries. Of the estimated 209,500 toy-related injuries, 76 percent were sustained by children 14 years of age or younger; 69 percent were sustained by children 12 years of age or younger; and 38 percent were sustained by children 4 years of age or younger.” Toy manufacturers should take a number of measures in order to ensure that their products are safe.
- Companies should make sure that all of their toys have an age-appropriate design.
- Companies should make sure that their toys are created with nontoxic materials.
- Companies should comply with all national and international toy standards.
- Companies should conduct a risk assessment in order to identify potential hazards with their toys.
- Companies should use third-party testing in order to ensure that their toys are safe.
All toy manufacturers have a legal obligation to ensure that their products are reasonably safe. They must take into consideration all of the ways that their toys could be used and even misused. It is well known that small children may stick certain toy parts in their mouths. If a toy has a design defect that contributes to an accident, this could form the basis of a strict product liability claim.
A number of lawsuits have been filed by people injured by toys. Consider, for example, Aleo v. SLB Toys USA, Inc. A 29-year-old woman tragically died when she hit her head on concrete after an inflatable swimming pool slide collapsed underneath her. A jury found that the company responsible for the device was liable for negligence and breach of warranty. It is important that certain steps are taken after any injury involving a children’s toy.
- Medical records related to the incident should be preserved.
- Eyewitnesses should be interviewed.
- It should be determined if the affected product was on any recall list.
- An experienced product liability attorney should be contacted.
The vast majority of injuries involving children’s toys are preventable. These incidents tend to involve products that did not adhere to safety guidelines. Part of the problem is that many unsafe products are imported from countries where safety guidelines may not be as strict. It is essential that accident victims understand that they do have legal options. They are able to seek some measure of accountability through a civil claim.
