Liability for Jefferson County Pedestrian Accidents

Every driver in Illinois has a legal duty of care to safeguard the well-being of other road users. This necessitates that they maintain their vehicle at a safe speed and abide by all traffic regulations. According to Illinois Vehicle Code 625 ILCS 5/11-601, “No vehicle may be driven upon any highway of this State at a speed which is greater than is reasonable and proper with regard to traffic conditions and the use of the highway, or endangers the safety of any person or property.” There are many other ways that a driver may have been negligent prior to a pedestrian collision.

  • Distracted Driving: A large portion of pedestrian accidents involve drivers that are distracted by their phones or other objects.
  • Headlights: A driver may have failed to use their headlights to properly illuminate a pedestrian or other obstacle in the roadway.
  • Fatigue: A driver may have allowed their ability to drive safely to be impaired because they were fatigued.
  • Speed: A driver may have been traveling too fast for the prevailing conditions, even if they were technically traveling the speed limit at the time of the crash.

If a driver fails to slow down to avoid a pedestrian in the roadway, this could be construed as negligence. Even if a pedestrian is in the middle of the roadway, that does not mean that a driver will automatically be cleared of liability in the event of a crash. Drivers should be able to slow down to avoid hitting stationary objects and other hazards. Liability for a pedestrian accident could extend beyond any driver held to be at fault. This is particularly true if a pickup truck or other vehicle was being used for some type of commercial purpose.

Steps to Take After Jefferson County Pedestrian Accidents

Car accidents remain a leading cause of preventable injury and death in Illinois and across the United States. According to the Illinois Department of Transportation, “Crashes involving pedestrians accounted for 1.6% of total crashes, 19.7% of fatal crashes, and 7% of injury crashes. Crashes involving pedalcyclists accounted for 1.1% of total crashes, 3.4% of fatal crashes, and 4.7% of injury crashes.” Certain action should be taken after any pedestrian collision.

  • All of the medical records associated with injury should be collected.
  • The nature and purpose of a driver’s trip prior to a crash should be understood.
  • The speed of the driver prior to the collision should also be investigated.
  • Photos of the accident site should be taken.
  • The family of any person who died should seek an independent review by team experience in accident reconstruction and negligence claims.

Pedestrian accidents tend to be highly preventable. They often involve drivers that were speeding or not properly scanning the road ahead of them. Unfortunately, this is not how many police departments and insurance companies will view these collisions. If any pedestrian is outside of a marked crosswalk when they were hit, they will nearly always blame the victim. This is why it is so important that these incidents are properly investigated by an outside party.
