Liability For Festus Pedestrian Collisions

According to the Governors Highway Safety Association (GHSA), “Drivers struck and killed an estimated 7,485 people on foot in 2021 – the most pedestrian deaths in a single year in four decades and an average of 20 deaths every day.” The vast majority of pedestrian accidents are preventable and often involve some amount of driver error. There are a number of steps that drivers should take to avoid hitting pedestrians.

  • Drivers should slow down at night and during periods of reduced visibility.
  • Drivers should be well rested before heading out onto the road.
  • Drivers should check their blind spots before making turns.

According to Illinois Vehicle Code Sec. 11-601, no person shall operate a motor vehicle at a speed greater than what would be reasonable or safe given the prevailing conditions of the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. There are several steps that should be taken after any pedestrian collision.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • A thorough investigation should be conducted.

Many victims of pedestrian accidents may not realize the full extent of their injuries for some time after an accident. Any person that is injured due to the negligent actions of a driver may have legal recourse through a civil claim. Sadly, though, drivers will often do everything in their power to deny liability for collisions. This is why it is so important that all evidence is properly preserved after any crash.
