Prior to the recall, the printers were sold online at Lexmark’s website and through CDW Logistics. A full investigation remains ongoing at this time.
Liability for Fires Caused by Consumer Goods
Residential fires are one of the leading causes of preventable injury and death in the US. According to the National Fire Protection Association, “In 2023, local fire departments responded to an estimated 1.39 million fires in the United States. These fires caused an estimated 3,670 civilian fire deaths and 13,350 reported civilian fire injuries. The property damage caused by these fires was estimated at $23 billion.” There are a number of ways that a consumer product could lead to a fire.
- There have been a number of situations where lithium-ion batteries within consumer products have overheated and caught fire.
- If the electrical cord on any product is frayed or damaged, this could easily lead to a fire.
- Any type of device that emits heat could cause a fire over time if it’s around insulated and flammable materials like blankets.
Companies that create consumer products have a legal obligation to ensure that they are reasonably safe. These products must adhere to all safety regulations set by the Consumer Product Safety Commission and other federal agencies. If a product has a design defect, the manufacturer or retailer could be liable for injuries caused by that product. There are several elements that must be shown in any product liability case.
- The defendant sold the product that the plaintiff was injured by.
- The defendant was listed as the commercial seller of that product.
- The plaintiff was injured by the use of the product.
- The product was defective when it was sold.
- The defect was both the actual approximate cause of the plaintiff’s injuries.
It can be hard to know what to do after being injured by a consumer product. This is especially true for any person who is burned in a fire. Burn victims will often need extensive surgeries in order to recover. This may include numerous expensive skin grafts. It is important that accident victims understand that they do have legal options if they are harmed by a consumer product. They may be able to hold the manufacturer or retailer liable.
