Liability for Injuries Involving Children’s Toys
Many children are injured in accidents with children’s toys and other products every year. According to the Children’s Safety Network, “Between 2015 and 2018, U.S. children and adolescents ages 0-19 sustained over 1 million toy-related injuries that were treated in emergency departments. This infographic provides data on categories of toys involved in injuries and differences in toy-related [injuries] for males and females.” Companies should take several measures to prevent their toys from becoming hazards.
- Testing: Companies should conduct many tests to see how their product will perform. In all the real-world scenarios it will likely be put through.
- Compliance: Companies should work to be compliant with all federal and state safety guidelines for toys. Among other things, toys should not have small parts that can break off and potentially be swallowed.
- Vetting: Companies should vet supply chain distributors that give them the parts for their products.
Companies have a legal obligation to create products that are reasonably safe. They must be particularly cautious when they create children’s toys. These toys should not be likely to cause injury when they are used as intended. If a child’s toy has a propensity to injure or malfunction during normal use, this may be a clear sign that it suffers from a design defect. If a design defect contributes to any child’s injury, this could form the basis of a product liability claim.
Steps to Take After Your Child Has Been Injured by a Toy
Falls are one of the leading causes of serious injuries for people. According to the Centers for Disease Control, “One out of 10 falls results in an injury that causes the older adult to restrict their activities for a day or more or to seek attention from the healthcare system. Each year, there are about 3 million emergency department visits due to older people falls.” Parents should take several actions if their child is injured in an accident with a toy.
- Medical Evaluation: Parents should ensure their child has a thorough medical evaluation. Many of the injuries associated with a fall will not be immediately obvious.
- Evidence Preservation: Parents should keep the items that caused the injury. It should be kept in a safe location where it will not cause additional harm.
- Legal Consultation: Parents should seek the guidance of an experienced product liability attorney. An attorney can examine the unique facts of your case free of charge and let you know what your legal options are.
The vast majority of accidents involving children’s toys are preventable. They tend to involve situations where manufacturers take safety shortcuts. For example, a manufacturer may fail to follow safety guidelines. The parents of any child injured by a consumer product may be able to seek some measure of justice through a product liability claim. Damages can help cover many of the expenses associated with an injury.
