Liability for Chicago Pedestrian Accidents
Every driver in Illinois has a legal obligation to use caution to avoid colliding with any pedestrian in the roadway. Pursuant to 625 ILCS 5/11-1003.1, every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian or any person operating a bicycle. Drivers must be particularly cautious if they encounter any child or person who appears to be confused. A driver may have acted negligently in many different ways prior to a pedestrian collision.
- Speeding: A large portion of pedestrian collisions involve a driver who is speeding. Drivers are less able to slow down in time to avoid hitting pedestrians when traveling at unsafe speeds.
- Dangerous Left Turns: Pedestrians have a naturally small profile and are more likely to be hit by drivers that make dangerous left turns or who fail to check their blind spots.
- Driver Intoxication: What many drivers don’t realize is that a number of substances could intoxicate them besides alcohol. This includes prescriptions and over-the-counter medications.
Depending on the facts of any case, there could be numerous liable parties for any pedestrian accident. If a driver was working at the time of a collision, their employer could be held at fault. As a general rule, employers are liable for the wrongful actions of their employees who were working within their job duties. A city could also be liable for a pedestrian collision if it was caused by a dangerous condition on public property.
Steps to Take After a Cook County Pedestrian Accident
Pedestrian accidents can leave victims with very serious injuries. According to one study in the National Institutes of Health, “The burden of injury upon the individual, families and society is frequently overwhelming. Although pedestrian injuries and deaths are relatively on the decline in the United States, this is not universally true throughout the world.” Victims of pedestrian accidents should take several steps to protect their rights.
- Medical Care: Any person injured in a pedestrian accident should seek immediate medical care. Follow-up care is also important. In many cases, a person’s injuries may worsen with time.
- Police Investigation: The police should be called to the scene so that they can begin an investigation.
- Surveillance Footage: Important pieces of evidence that may have captured the crash should be sought. Many accidents are captured by surveillance footage.
- Legal Support: It is always a good idea to seek legal guidance after any pedestrian accident. An attorney can take steps to hold the negligent driver accountable for their actions.
Going through a pedestrian accident can be extremely stressful. Victims may need to take long periods away from their jobs. They could also be left with high medical bills. To make matters worse, the drivers responsible for these collisions and their insurance providers will never accept responsibility for what happened. This is why it is important for accident victims to seek the guidance of an attorney.
