Liability For Cook County Pedestrian Accidents

Speeding remains one of the leading causes of pedestrian deaths in Chicago. According to the Chicago Department of Transportation, “70% of Chicago traffic deaths involved drivers traveling at high speeds. Over half of pedestrians killed in the city are hit by an SUV or larger vehicle.” Cities can take a number of different actions in order to prevent pedestrian accidents.

  • Cities should install traffic-calming measures in areas with frequent speeding.
  • Cities should heavily enforce traffic regulations that are likely to lead to pedestrian collisions.
  • Cities should make sure that traffic intersections are well illuminated.

All drivers must use caution in order to avoid hitting pedestrians. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-1003.1, every driver must exercise due care to avoid colliding with any pedestrian. They must also use their horns when necessary and exercise the proper precautions to avoid colliding with any child or obviously confused person. When a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Several factors could contribute to a pedestrian collision.

  • Distracted driving
  • Inclement weather
  • Dangerous left turns
  • Driver intoxication

The vast majority of pedestrian accidents are preventable. They tend to occur at intersections. In particular, many drivers fail to check for cross traffic as they make left turns. Sadly, though, drivers will often do everything in their power to deny responsibility if they are involved in a collision. Any person injured in a pedestrian accident may have legal recourse through a civil claim.
