Liability for McHenry County Home Explosions
Gas leaks remained one of the leading causes of home explosions in the United States. According to CBS News, “Since 2010, according to data from the U.S. Pipeline and Hazardous Materials Safety Administration (PHMSA), there have been 3,138 significant gas leaks incidents – 390 resulted in an explosion. These incidents have injured 725 and killed 163 people.” There are a number of common causes of gas explosions.
- Faulty Appliances: A gas explosion could be the result of faulty appliances that are leaking gas. These appliances may have old or corroded parts. It is also possible that they were not installed correctly.
- Inadequate Ventilation: Appliances or devices that release natural gas may be in enclosed areas that are not properly ventilated.
- Ignition Sources: Gas explosions require an ignition source. This could include electrical sparks or open flames.
Gas companies have a legal obligation to protect customers from reasonably foreseeable sources of harm. They must periodically inspect and maintain all of their infrastructure. This should include checking for leaks and responding in a timely manner during emergencies. If a gas company has actual or constructive notice of a dangerous condition with their lines and fails to take action, this could form the basis of a negligence claim in the event of an accident.
There have been a number of lawsuits related to people injured in gas explosion accidents. Consider, for example, Metz v. Central Illinois Electric & Gas Co. The Illinois Supreme Court held that gas companies can be liable for an explosion. In that particular case, attorneys for the plaintiff argued that the gas company’s negligence was the most likely cause of the explosion. The court sided with the plaintiff and allowed the case to proceed under the doctrine of res ipsa loquitur. Victims of gas explosions tend to suffer very serious injuries.
- Burn injuries
- Blast injuries
- Organ damage
- Fractures
- Eye and ear injuries
It can be hard to know where to begin for someone injured in a home explosion accident. But it is important that there is a thorough investigation into the cause of the explosion. If negligence played a factor in the explosion, victims may have recourse through a civil claim. Damages in a civil claim can help cover many of the harms related to injuries. These types of cases can be very complex and may involve negligence on the part of several different parties.
