Liability for Williamson County Dog Attacks

Dog attacks remain one of the major causes of preventable injury and death for people living in Illinois and across the United States. According to the American Veterinary Medical Association, “The agency attributed over 300 deaths to dog attacks between 1979 and 1996, most of them children’s. An analysis by the Agency for Healthcare Research and Quality found roughly 316,000 emergency room visits and 9,500 hospitalizations in 2008 were dog bite–related.” There are a number of steps that dog owners should take in order to avoid dog attacks.

  • Dog owners should properly secure their animal in their home or within their yard.
  • Dog owners should only let their dog off-leash in designated off-leash areas.
  • Dog owners should socialize their dog at a young age.

Dog owners have a legal obligation to take reasonable measures in order to prevent people from being injured by their animal. Owners are held strictly liable if their dog attacked someone. Pursuant to 510 ILCS 5/16, “If a dog or other animal, without provocation, attacks, attempts to attack, or injures any person who is peaceably conducting himself or herself in any place where he or she may lawfully be, the owner of such dog or other animal is liable in civil damages to such person for the full amount of the injury proximately caused thereby.” Victims of dog attacks should take several measures in order to protect their legal rights and health.

  • They should seek a medical evaluation as early as possible.
  • Victims should try to determine who owned the dog that attacked them.
  • A police report of the attack should be created.
  • Eyewitnesses should be interviewed.

Many of the injuries associated with dog attacks are not always immediately obvious. The mouths of dogs are filled with millions of bacteria that compose a serious risk of infection. After a victim of a dog attack has sought a medical evaluation, it is also a good idea to seek the guidance of an experienced personal injury attorney. Any person injured in a dog attack may be able to seek some measure of accountability through a bodily injury claim.
