Liability for Lake County Garbage Truck Accidents
Garbage trucks and other larger vehicles can be particularly dangerous for motorcyclists. According to the National Safety Council, “The number of injuries in large-truck crashes increased 3.9% in 2022, to 161,000. As with deaths in large-truck crashes, most of the injuries occurred to occupants of other vehicles (73%), followed by truck occupants (26%) and non-occupants (1%).” Truck drivers should take a number of measures in order to avoid hitting motorcyclists.
- Rest: Truck drivers should be well rested before they head out onto the road.
- Blind Spots: Truck drivers should check their blind spots before changing lanes or making turns.
- Maintenance: Truck drivers should ensure that their vehicles are routinely inspected and adequately maintained.
Truck drivers are required to obtain a commercial driver’s license. They must be intimately familiar with how to handle their vehicle safely in all of the conditions they will likely encounter. Many collisions are due to truck drivers that make dangerous left turns. Pursuant to Illinois Vehicle Code 625 ILCS 5/11-801, the driver of any vehicle intending to make a left turn must first yield the right-of-way to all drivers that are close enough to pose a hazard. If a garbage truck driver makes a left turn in front of another vehicle, this could form the basis of a negligence claim.
Liability for a truck accident could extend beyond any driver. The company that a garbage truck driver worked for could potentially face liability. Generally speaking, employers are vicariously liable for the wrongful actions of their employees—insofar as those employees were operating within the course and scope of their job duties. This could include situations where a garbage truck driver was picking up trash along a designated route. It is important that certain steps are taken after any garbage truck accident.
- Surveillance footage that may have captured the accident should be sought.
- Eyewitnesses that may have seen what happened should be interviewed.
- Medical records related to any injuries should be collected.
- The accident should be reported to the police as soon as possible.
It can be difficult to know where to begin after a garbage truck accident. Victims tend to suffer catastrophic injuries that often result in very high medical bills. It is also common that accident victims may need to take extensive periods of time away from work. Sadly, though, garbage truck companies will often do everything in their power to deny liability if one of their workers seriously injures someone in an accident. This is why it is so important for victims of these accidents to seek experienced legal counsel as early as possible.
